I've seen these coming thru namewinner, and presented them to clients. Can't you get a c and d letter real easy from the organization claiming infringement of copyright?

C&D letters aren't sent to some because they mention a team name. For the most part, they want you to get the domain, create a forum, and get some buzz going in an attempt to sell more tickets/merchandise.

It's hard to get short phrases and names copyrighted, anyway. The logo/mascot is easy to get a copyright for, so if you use those, you're in violation. Since the short phrases/names cannot be copyrighted, Bucks, 76ers, ect are not protected. It is possible that courts will side with the most well known, but that could only be the case if you actually owned <city><team name>.com. More than likely the courts would side with you (if you have one of the domains I listed) because 76ersChat.com is not easily confused with the offical 76ers homepage. C&D letters are really only sent to people using the logo and making a profit from that logo. Fan sites are not a problem.

I think someone suggested it a while back, I guess it'd be a pretty good idea, but I don't see the difference from a site like, say, justdropped.

DNForum has a lists forum for domains that dropped or that have never been rigistered. The nice thing about it is they weed out the junk domains that dropped because they were actually worthless. Other people run scripts to find out what domains have OVT with extension, PR, or something else.

sjag when i furnish such names, like ucla foorball or basketball, that is the response i get. they can take it over at any time if you mention their brand.

ucla is copyrighted, so is bruins football, since there is only one. so if you bought it and made it into a chatroom, they might wait until you had something major and then grab it. if you made money from their logo and franchise with ads and stuff they might sue you for it.

That's what I thought, if your site gets big and you've got something copyrighted, they'll get you... but if it stays small, I don't think they'd waste their time.

I know people with YankeesBaseball.com and the Yankees know about it and do not care. Most teams wouldn't care. It is possible that if you get too big with the chat room about a team, they could get mad and send a C&D, but they could not take it away. You can own something that is copyrighted as long as it is different. For example, M&M is copyrighted several times, but only on is used for candy. PayPalSucks.com is up and running because it isn't easily confused with Paypal.com. It just depends on how far they went with the trademark, service mark, and copyright. There's not much you can do with team names. In fact, you can take a logo, change the color, and get it copyrighted yourself.

but sjag the brand and chat would obviously in this case be about "yankee baseball", if that guy had a sig that said $102.00 a day and counting i bet he'd hear from them soon. Most teams do want to brand and copyright their entities. Any domain buyer that wants to do this is risking that every day he'll get a c and d. yes a judge can stop Ethelred P. Webmaster to cease and desist from any and all web sites hosting and domain web sites involving the x name. And the yankeesbaseball people aren't over yet. The Yankees organization could decide three years from now to have him audited and sue for damages and a cut of the pie.

YankeesBasesball.com is definitely about the New York Yankees. The domains I listed are not. Plus, I searched for EVERY baseball, basketball, and football team and those were the only ones available. It's highly unlikely you would loose the domain. It's highly unlikely anyone would challenge the domain.

The trademark only protects the full name. NewYorkYankees.com was taken by the Yankees. YankeesChat.com is NOT infringing on the protected trademark. It's also NOT a baseball team. It's a chat/forum. The Yankees do have rights to it.
